Kampala: The constitutional court of Uganda comprising of five judges today ruled the Anti Homosexuality Act (AHA) null and void stating that the Law was passed without quorum from members of parliament. The panel comprising of Steven Kavuma, Augustine Nshimye, Eldad Mwangusya, Solomy Bulunji Bossa and Rubby Aweri; unanimously came to an agreement after a three days’ deliberation that the Law illegally passed.
“We are happy that justice has prevailed but iam worried now more than ever about backlash. OnePastor Kiganda said on radio that if the Law was nullified, then there would be a killing of LGBTI persons. This pastor has followers who would take this seriously. Members of the LGBTI community should celebrate this victory but bear in mind that hate and violence will continue or may even escalate.” Said Diane Bakuraira; The chairperson board of Directors: FARUG.
According to a statement issued by HRAPF: one of the petitioners, The attorney general didn’t deny allegations of lack of quorum but insisted the petitioners had to adduce empirical evidence showing there was lack of quorum. The evidence adduced by the petitioners included an affidavit by Hon. Fox Odoi one of the petitioners and also a member of parliament and copies of handsands showing the procedure of parliament the day the act was passed.
“I expected a win for us when the hearing was brought forward from the scheduled September to august. That and the fact that after government issued a statement and immediately after AID started coming to Uganda. Nonetheless i am thrilled. We won.” Said Nkali Biggy of FARUG.
The anti homosexuality Bill was first tabled in parliament in 2009 by Hon. David Bahati. It then went through a series of debates and shelving and was finally passed on 20th 12 2013.
This is a great victory and will go a long way to set precedence for human rights observation in Uganda. It also reflects the autonomy of the judiciary as an independent arm of government.
